the fire danger in southern california slows down overnight. winds destroyed homes and forced thousands of evacuations relent, but for some it's too late. >> reporter: how fast did this fire take off? within 15 minutes. >> reporter: it was all gone? >> it was all gone. feeling the pressure after details of the nsa spying program were made public, president obama reveals his reform for the spy agency today, but many of the government's surveillance programs are expected to remain intact. it's the dream football matchup with a trip to the super bowl on the line. tom brady and the patriots get ready to take on peyton manning and the broncos. and the big 5-0. the first lady marks a milestone birthday today.

captioning funded by cbs captioning funded by cbs this is the "cbs morning news" for friday, january 17th, 2014. good morning. good to be with you. i'm anne-marie green. well, this morning firefighters battling a dangerous wildfire east of los angeles are making progress. the fire destroyed five homes and forced nearly 4,000 people to evacuate. red flag warnings will remain in effect until later today, but for now the santa ana winds that pushed the flames early yesterday has subsided. the fire is 30% contained this morning. it's one of several burning in the state which is suffering through a severe drought. teri okita is at the fire command center in irwindale early this morning. good morning, teri. >> reporter: good morning, anne-marie. i spoke with the fire inspector. he says things have burned down quite a bit which is good news, however, they're still monitoring closely the

worrisome unpredictable santa ana winds this morning. high winds whipping through the san gabriel mountains burning 30 miles east of los angeles. many residents could only watch in disbelief. >> it started off with a couple little embers. we thought we were safe. i really don't know right now. >> reporter: more than 700 firefighters are scrambling to put out hotspots through the 1,700 acres of charred brush. they're trying to stop the fires from advancing into populated neighborhoods for now. firefighters say they're most concerned about the santa anna winds and the flying embers. the red flag warning has been extended into at least friday evening. flames destroyed five homes and damaged more than a dozen others. the fire burned around becky smith's home. her 80-year-old father and mother escaped with nothing more than the clothes on their backs. >> they don't have anything now.

>> i'm having a more difficult time than i'm showing, okay? >> reporter: at least a thousand people remain under evacuation orders including matt and lisa ellison. matt decided to stay but lisa left as the fire crept closer. >> i was pretty nervous especially when it came over the ridge. i kind of freaked out actually. >> reporter: three men are charged with recklessly starting a fire. what started as a campfire was fueled by dry brush untiched by wildfire in 46 years 678 so i'm told they're in sort of a holding pattern right now. most of the firefighters are resting and sleeping while there are a few fire crews upton line monitoring for any hot spots that may flare up. fire officials say they may have more information once day breaks. anne-marie? >> teri, thank you very much. gusting winds and blowing snow led to whiteout conditions in south dakota. wind gusts of 50 miles per hour were recorded into last night.

travel was treacherous from iowa to minnesota. and the white house says president obama will sign a $1.1 trillion budget deal. the senate easily passed the measure yesterday, day after it passed the house. the bill funds the budget for over a year. later today the president details his plans for overhauling the nsa surveillance program. of course, most of the changes will have to be approved by congress and the courts. the president's speech follows a month-long white house review triggered by the edward snowden leaks. susan mcginnis is in washington. susan, good morning. >> anne-marie, good morning. the president will travel over to the justice department today to give this big speech. this is his first appearance there. he will likely announce new limits on the nsa programs that collects billions of americans' phone records, but many say it won't go far enough. cbs news has learned president obama plans to keep most existing surveillance programs in place when he outlines his

new vision for the national security agency. >> he will want to demonstrate that there's oversight of that, that there is transparency in how this is done and that it cannot be abused. >> white house sources says it will allow the nsa to keep data it collects even though a review panel recommends it be stored with private companies. >> the question is how to avoid that potential abuse. one of the ways we decided to avoid that is to take it out of the hands of government. >> the government received criticism after ed w5rd snowden revealed the sweeping extent of the practices. in response the president is expected to call for a privacy advocate to see which phone and data records of foreign nationals and suspected terrorists are looked at, but critics want more. >> we think this whole program is not only ineffective, but it's unconstitutional. >> as for spying overseas, it's

the obama administration is now expected required to seek approval by a senior official before anyone listens in on a phone call from a foreign head of state. now, the white house was still reportedly grappling last night with a controversial issue here. who is to hold all of this metadata? should it stay with nsa, private telecons who lobbied against it? we believe sources say the president will say the nsa holds onto that data. oklahoma senator tom coburn is retired. coburn, a republican, was elected to the senate in 2004. before that he served three terms in the house. he announced last night he'll serve out the current session and step down with two years left on his term. he is a conservative and critic of excessive government spending. new jersey governor chris christie travels to florida today to attend a series of political fund-raisers.

it's christie's first out-of-state appearance since a political payback scandal rocked his administration. yesterday christie met with storm victims as the state assembly voted to investigate the lane closings leading to the george washington bridge. a special legislative panel issued 20 subpoenas. the family of man put to death thursday in ohio plans to sue the state. dennis mcguire's relatives say his execution amounts to cruel and unusual punishment. it took 25 minutes for him to die. mcguire made several snorting noises and appeared to gasp. >> the people of the state of ohio should be appalled at what was done here today in their names. >> last week mcfwiesh giers lawyers tried to halt the execution because the cocktail of drugs had never been used.

>> good morning, anne-marie. that security breach that hit target appears to be part of a broader highly sophisticated scam that affected several retailers. as many as 70 million target customers may have had their personal information stolen. a cyber intelligence firm said yesterday that the breach started in june and that malware used to gather the information can cover its own tracks. asian markets were mostly lower following downbeat news on wall street. tokyo's nikkei lost a fraction. hong kong's hang seng gained half a percent. some disappointing earnings news led to a mixed day here on wall street. best buy reported a decline in sales for the holiday season. goldman sachs and citigroup also reported less than expected results. the dow jones industrial fell nearly 65 points. the nasdaq composite gained almost 4. the cost of flying is taking off. the cost to buy an airline

ticket has gone up for the fourth straight year. about $7 for a round trip ticket or 2%. prices have increased as airlines have merged and eliminated unprofitable routes. the increase does not take into account all the extra fees passengers now face. a california driver has been cleared in a google glass case. in the first case of its kind, cecilia was pulled over for speeding. she was cited when the officer noticed she was wearing google glass. she was found not guilty because the officer did not provide proof that the device was operational. and google says it has developed a contact lens that monitors glucose levels in tears. that's potentially big news for diabetics who now have to check their sugar levels by drawing blood as many as ten times a day. google says it will take at least five years before it reaches consumers. that's pretty neat. anne-marie? >> that is pretty neat.

wendy gillette at the new york stock exchange. well, russell johnson, who portrayed one of television's most memorable characters has died. ♪ the professor and mary ann here on gilligan's island ♪ >> "gilligan's island" made johnson a familiar face to millions of television series. as the professor he was the brains of the bunch of castaways. it ran for only three seasons in the 1960s but continues in reruns. he died at his home on bainbridge island, washington, yesterday. russell johnson was 89. and small screen funny man dave madden is dead. he played the agitated band manager ruben kincade on "the partridge family." in that role he and preteen danny bonaduce frequently clashed in a comedic effect. he also appeared on "bewitched" and "love boat." dave madden died in florida. he was 82.

of a risk of your favorite baseball team losing because of a bad call by umpires next season. major league baseball approving an expansion of instant replay. on thursday. imaginers will be allowed to challenge at least one call per game. if the challenge is upheld, the manager gets another and after seven, a crew chief can request a review on his own. commissioner bud selig said it will change the game without disturbing it. >> in the past i could be sitting at home watching a game, get all the replays, and pat courtney, well, he deserved it, but anyway, could be sitting at the ballpark and he couldn't see any of these replays. it's just wrong. >> all 30 mlb owners approved the rule change. and there are two big football games on the schedule for this sunday and one big story line.

the denver broncos and new england patriots are getting ready to play in the afc championship game with the winner going to the super bowl. it will also be the fourth playoff meeting between star quarterbacks peyton manning and tom brady. both signal callers talked about their relationship and sunday's matchup. >> i enjoy really trying to get to know, you know, a number of quarterbacks, and any chance you get to spend some time with them maybe in the off-season at a banquet or golf tournament talking a little ball, i've always enjoyed that part of it. i've certainly enjoyed that with tom. ? he's a great player and they've got great team, one of the best offenses in history. i think what that means for us is we've got to be ready to score some points. >> broncos versus patriots, manning versus brady, all with a trip to super bowl xlviii on the line. the only place to watch the afc championship game is right here on cbs sunday at 3:00 p.m. eastern. the nfc title game pits san francisco against seattle.

here's another look at morning's top stories. crews are making progress fighting a wildfire that destroyed five homes east of los angeles. it's 30% contained and no longer advancing. officials say a campfire got out of control. and this morning president obama will unveil proposals to rein in government surveillance. his speech caps a six-month review of nsa's spying. it comes amid a new report that the agency collects 200 million text messages every day from around the world. the 86th academy awards will be handed out on march 2nd. on thursday we learned who's in the running for an oscar statute. teri okita takes us through the nominees. >> reporter: "american hustle"
